Here’s a hypothetical example of something that could happen. Suppose that your tenant ignores the “no pets” clause in the lease agreement and brings home a huge canine bundle of joy because he saw it in an animal shelter and it tugged at his heartstrings.

Unfortunately the tenant has only just acquired this new pet, and has virtually no knowledge of its previous history. The tenant hasn’t had time to interact with the pet and certainly hasn’t had time to train it. Upon arriving at your home, the dog has a major freak-out.

It tears around the house bumping into the furniture, scratching up the floor, and does something completely unmentionable to the carpet. The horrified tenant puts the dog out in the yard and desperately tries to clean up the mess before it becomes a more permanent problem.

Out in the yard, Fido’s excitement and bewilderment only become worse. He digs furiously at the ground, decimates the flower bed, crushes the tree you planted last winter, and then spots a gap at the edge of the gate he can squeeze under.

Now free to unleash the full reign of his terror on the neighbourhood, Fido barks furiously at a seven year old on a bicycle. The kid loses control of the bike and swerves into the path of an oncoming car. The driver, fortunately, sees the danger and reacts instantly, but the edge of the bumper still clips the kid and sends him sprawling, while the car goes off the road and crashes into a neighbour’s mailbox.

Your tenant rushes out of the house, grabs Fido, drags him back home, and gives him a stern telling off. What an amazing chain reaction of events. Now who is liable for the cost of all the damage? If you guessed it was the tenant, you’d be sadly mistaken.

At best, the tenant is liable only for the damage to your carpet and furnishings, and even then only because he disobeyed a clause in the lease agreement. Plus you will be unlikely to actually recover any costs outside of the rent deposit they have paid because the tenant most likely does not have insurance and most likely does not have the money to pay for the damages.

The real threat is those third-party costs. There’s no way a lawyer is going to go after the tenant for damages. The lawyer will go to where he or she thinks the money is, and that’s you. You’re expected to have landlord insurance, after all. They’ll be really surprised if you don’t have it, but you’ll still be stuck with all the liability anyway, because you own the property.
